National Minimum Wage Rates 2025 — UK

The National Minimum Wage (NMW) and National Living Wage (NLW) are set annually by the government following recommendations from the Low Pay Commission. From 1 April 2025:

What Counts as Pay for NMW Purposes?

Not everything that appears on your payslip counts as "pay" for minimum wage purposes. The following cannot reduce your hourly rate below the minimum:

What Time Counts as Working Time?

Working time for NMW purposes includes time you are actually working, on-call time where you are required to be at or near the workplace, time spent travelling between assignments, and some training time. It does NOT include your own travel to and from work, or time spent on rest breaks.

Sleep-in shifts: Workers on sleep-in shifts (e.g., care workers who sleep at work) are entitled to NMW for their entire shift including sleeping hours, following the Supreme Court ruling in Royal Mencap Society v Tomlinson-Blake [2021]. However, HMRC guidance and case law in this area is complex — seek advice.

What Happens If Your Employer Underpays You?

Non-payment of the minimum wage is a criminal offence and a serious breach of employment law. If your employer underpays you:

  1. Calculate the underpayment using this tool and keep records of your hours and pay.
  2. Raise the issue directly with your employer — they may claim it was an error.
  3. If unresolved, report to HMRC anonymously at gov.uk/minimum-wage-reporting or call 0800 917 2368. HMRC investigates complaints for free.
  4. You can also bring an Employment Tribunal claim for unlawful deduction from wages. ACAS early conciliation is required first (free service, 0300 123 1100).

HMRC can require employers to repay all arrears plus interest and can impose a penalty of 200% of the underpayment (minimum £100, maximum £20,000 per worker). Employers found guilty of deliberate non-payment can also be prosecuted and disqualified from being a company director.

What is the National Minimum Wage in 2025?+
From 1 April 2025, the National Living Wage for workers aged 21 and over is £12.21 per hour. For 18–20 year olds it is £10.00/hr. For workers under 18 (above school leaving age) and apprentices in their first year (or apprentices of any age under 19), the rate is £7.55/hr.
Can my employer take money off my wages that brings me below minimum wage?+
No. Deductions for uniforms, equipment, tools, or other work-related items cannot reduce your effective hourly rate below the NMW. The only deduction that can legally reduce apparent pay below NMW is tax, National Insurance, and pension contributions (which are already accounted for in the gross rate).
Am I entitled to minimum wage on a zero-hours contract?+
Yes. Workers on zero-hours contracts are entitled to NMW for all hours worked. Your employer cannot pay you less than minimum wage for any hours you actually work, regardless of the contractual arrangement.
Do tips count towards minimum wage?+
Since 1 October 2024, tips paid through the employer's payroll or tip pool system can no longer be counted towards NMW — they must be passed on to workers in full on top of wages. The Employment (Allocation of Tips) Act 2023 gives workers the right to 100% of tips and service charges.
Is the Living Wage Foundation Real Living Wage the same as the legal minimum?+
No. The Living Wage Foundation's 'Real Living Wage' (currently £12.60 nationally, £13.85 in London) is a voluntary rate based on actual living costs — it is higher than the legal minimum. The National Living Wage (NLW) of £12.21/hr is the legal minimum. Employers can choose to pay the higher voluntary rate, and over 14,000 employers are accredited by the Living Wage Foundation.
